Here Come The Judge: Outsider To Hear Winkler DA Removal Case

WINKLER COUNTY–According to Winkler County Attorney Scott Tidwell, a visiting judge could be selected, by this week, to hear the details of the petition against Winkler and Crane County District Attorney Michael Fostel.

The reason for that is because District Judge James Rex has recused himself from the case. Tidwell says he plans to do the same. That’s because both of them could possibly be called as witnesses.

As NewsWest 9 first reported, Tidwell filed the petition, submitted by Winkler County resident John Walton, who claims Michael Fostel can’t be doing his job properly if he’s out of the office so frequently.

Fostel says he has been out for medical reasons and that he had an agreement, approved by Tidwell and

ARAFILES CHARGED WITH SAME FELONIES AS THE NURSES HE TARGETED

THIS TIME THE CHARGES ARE VALID

Winkler County Texas has come FULL CIRCLE. Dr. Arafiles has been charged and the sheriff and prosecutor should be next.

From the beginning we called shenanigans on the Winkler County Sheriff and prosecutor. On July 21, 2009, Law Med was prophetic:

“I call shenanigans on the Winkler County DA. Assuming that he is not an incompetent boob, and that he actually went to, and graduated from, law school, the only explanation for his abuse of power is collusion with the physician. It is impossible for his office to have adequately investigated the complaint allegations to allow a good faith conclusion that it was an “attempt to harm” the physician. Winkler County Hospital Administrator Stan Wiley Sneaks Out Of Town [VIDEO]

It appears Winkler County Memorial Hospital Administrator Stan Wiley not only resigned without warning or notice on Monday, he also apparently packed up his belongings last week in anticipation of simply saying “I quit” to his staff, walking out the door and driving out of town. Stunned hospital board members likely regret not accepting his resignation in August and at least one Board member is firing on all cylinders when she suggested that fired quality assurance and medical staff credentialing nurse Anne Mitchell be made Administrator. I know a Director of Nursing she could fire the moment she arrives for her first day on the job.

There can be little doubt remaining as to whether Stan Wiley is fit to be a hospital administrator.

You can’t make this stuff up.

There He Goes Again: Winkler County Hospital Administrator Wiley Resigns

I wonder if Donna Paehl, RN, Director of Nursing has yet seen the light after her glowing endorsement of Stan Wiley and delusional rant about how persecuted her poor Winkler County Memorial Hospital has been in the media and the court of public opinion. Apparently hospital administrator Wiley has somehow come to Jesus.

Wiley, 67, resigned suddenly on Monday, effective immediately and without explanation. After his charade in August when he announced his upcoming resignation and then when the time came did an about face after the hapless hospital Board refused to accept it, this time it appears it might stick. His previous attempt was chalked up to ‘having a bad day’ apparently. Leaving the Board out of it while he slips out the back door is the best decision we have seen come out of the administrative offices at the hospital in the last 2 years.

And So It Goes At Winkler Memorial Hospital

Let’s recap.

1.   The Winkler County Memorial Hospital enacted a policy which forbid (quite contrary to state law) their staff from reporting concerns over the professional clinical performance of a member of the medical staff without first obtaining approval from administration.

2.   Two nurses, Anne Mitchell and Vickie Galle, who worked there for decades and were in positions specifically responsible for Quality Improvement, Risk Management and Medical Staff Credentialing, brought serious documented concerns over one of the few physicians at the small hospital, to the administration and the chief of the medical staff. Dr. Rolando Arafiles had been recruited by the hospital, since physicians are often difficult to find for small, rural facilities. The hospital has 25 beds. He had already had a restriction placed on his Texas medical license, imposed by the State Medical Board

Dr. Arafiles to be Formally Disciplined June 10th: After Putting RNs Through Hell

— The backroom scheming and shenanigans in Winker County Texas have come round full circle and now are steam rolling towards those responsible. Dr Rolando Arafiles, the infamous natural supplement multi-level marketer will reportedly be formally disciplined on the complaints two Winkler nurses were fire for making  and were charged with felonies for doing so, by the Dr.s golfing buddy, County Sheriff Robert Roberts. A civil suit by the nurses is still pending and we will report an update on that shortly.

The Unbelievable, But True Story of the Nurses of Winkler County: Part 4

After the Grand Jury was led down the path in the garden of good and evil by county attorney Tidwell, Mitchell and Galle were arrested and charged with Misuse of Official Information under Section 39.06(b) of the Texas Penal Code: “A public servant commits the offense of Misuse of Official Information if with the intent to harm another he uses information for a nongovernmental purpose that (1) he has access to by means of his employment and (2) has not been made public.”

Because Mitchell and Galle were employed by a county hospital they are considered public servants for the purposes of this criminal statute. Since the information they sent to the Texas Medical Board was accessed by means of their employment and was not public information, it is considered ‘Official Information’. The Unbelievable Story of the  Nurses of Winkler County

In the spirit and tradition of a favorite South Park episode where the boys are taken for a ride by a shady carnival huckster, I called shenanigans on the prosecution of Anne Mitchell and Vicki Galle on July 21, 2009, shortly after charges were brought against them. While I followed their saga to it’s favorable conclusion, I confess that I did not pay enough attention or do enough digging to discover and understand entirely the events which led to one of the most absurd and unjust abuses of power by state health and welfare and law enforcement officials imaginable. As a general rule I have no patience for things that are unfair.
