Righthaven Federal Lawsuit Against This Blog Dismissed

As we recently told you, the lawsuit filed against the Law Med Blog (one of some 275 such lawsuits) by the now defunct Righthaven, Inc. alleging copyright infringement was bullshit. We also told you that we had a Motion to Dismiss with Prejudice for Failure to Serve the Complaint, Willful Deception, and Failure to Comply with a Judicial Order pending.

The Nevada Federal District Court has dismissed the complaint for failure to effect service but declined to order the sanctions we requested, commenting: “While the accusations contained in the Motion to Dismiss are troublesome, at this time the Court shall decline to award sanctions or to dismiss with prejudice.”

We will not appeal the sanctions denial since Righthaven is done for and there is zero chance they can re-file the complaint, since they have been stripped of all copyrights they claimed to have held.

Righthaven Fails To Oppose Our Motion To Dimiss

Righthaven LLC had 14 days in which to file a response to our Motion to Dismiss with Prejudice for Failure to Serve the Complaint, Willful Deceit, and Failure to Comply with a Judicial Order, filed in Nevada Federal District Court on September 6th. They have failed to do so…and we did not think they would risk filing one since the only reason to would be to oppose our motion on the basis that our allegations of their multitude of lies before the court was false. In other words they would have to lie again to the court. They may finally have recognized that, even for them, there is a limit to their arrogance blinding them to their stupidity.

Had they filed a response in opposition, they would also have enticed the court to address their lies and ethical violations with specificity, and issue findings regarding them. Something Righthaven likely wishes … (Continued…)

Righthaven Death Watch Enters Welcomed Stages

Legal extortionist and internet copyright troll Righthaven LLC, the company suing this blog and some 275 others in federal court, is gasping for air. Thursday Wired.com reported MediaNews Group, the parent company of the Denver Post, announced they have fired Righthaven in a rather introspective statement of regret that they had ever been associated with the scoundrels, calling it “a dumb idea”.

The new chief executive of MediaNews Group, publisher of the Denver Post and 50 other newspapers, said it was “a dumb idea” for the nation’s second-largest newspaper chain to sign up with copyright troll Righthaven.

The Denver-based publisher’s year-long copyright infringement litigation deal with Righthaven is terminating at month’s end, said John Paton, who replaced Dean Singleton to lead the company on Wednesday.

Law Med Blog Files Motion To Dismiss Federal Righthaven Lawsuit

The deadline for Righthaven LLC to serve the Law Med Blog with the lawsuit they filed against us in Nevada Federal District Court back on May 5 came and went on September 2. A plaintiff has 120 days to serve a defendant with the complaint in a lawsuit filed in a federal court. Once they fail to do so, the defendant is permitted to motion the court to dismiss the action. Such dismissals are done ‘without prejudice” meaning the plaintiff can turn around and re-file the lawsuit if they wish. 

This blog however, has filed a Motion to Dismiss With Prejudice for Failure to Serve the Complaint, Willful Deceit, and Failure to Comply with a Judicial Order on Friday.
