Indictments of Dr. Desai and CRNAs Follows $500 Million Award to Hepatitis C Victim

We previously reported on the record breaking $500 million jury award for Henry Chanin, who contracted Hepatitis C from improper injection of the drug after it had been used on another patient. Teva and Baxter, both pharmaceutical companies were on the hook for he whole bill as they had been sued for improperly packaging the drug propofol as if it were a multi use medication. But Chanin got Hepatitis C not because of a pharmaceutical company, bur because of the greed of 3 health care professionals who were well aware of the complete prohibition on the reuse of propofol vials and the danger such behavior posed.

Now, they are before the court. Not to answer the thousand or so malpractice claims filed, but because they have been indicted on 28 criminal counts including racketeering, fraud, performance of an act in reckless disregard of persons or property, criminal neglect of patients, insurance fraud, theft and obtaining money under false pretenses. All are felonies. Dr. Dipak Desai and nurse anesthetists Ronald Ernest Lakeman and Keith H. Mathahs are accused of causing more than 40,000 patients to be potentially exposed to Hepatitis C and B and HIV. All the patients had to be notified to get tested.  Desai and his anesthesia cohorts decided to save a buck or two by using what are supposed to be single dose vials of propofol on multiple patients, billing each of them for the same drug vial. propofol has a protein base which encourages the growth of bacteria and viruses and all anesthesia providers are well aware that the drug cannot be used on more than one patient.

Desai’s bail was set at $1 million and the CRNAs $500,000 each. Read the indictment HERE.
