Plaintiff Awarded More Than $500m In Propofol Hepatitis C Lawsuit

Jurors in a Las Vegas courtroom held Teva and Baxter pharmaceuticals responsible for Henry Chanin, 62, having contracted Hepatitis C from contaminated propofol, an anesthetic that both companies distribute.

Chanin sued Teva Parenteral Medicines Inc. and Baxter Healthcare Corp. after contracting Hepatitis when he was administered propofol at the Desert Shadow Endoscopy Center. Tens of thousands of patients were placed at risk because of failure to comply with procedures recommended for anesthesia professionals handling propofol. The jury found however that the two companies created the danger because of their methods of packaging propofol in large vials.

Because of its unique protein composition, propofol is an ideal auger for growing various bacteria and viruses and should not be used on multiple patients, despite large 50-100 ml vials marketed similar to multi-dose vials of other medications.

Chanin is one of hundreds who have filed suit.The jury awarded Chanin $3.25 million in compensatory damages. His wife, Lorraine, was awarded $1.85 million for loss of consortium. Punitive damages were also awarded and the jury was deliberating today to determine the amount.
