Defense In Tidwell Trial Rests Without Calling Any Witnesses [VIDEO]

After a 5 hour delay on Friday, the defense in the criminal trial of Winkler County Attorney Scott Tidwell surprised the courtroom by resting their case without calling a single witness. Attorneys for both sides met with the judge in chambers for 5 hours without a break before coming back to the courtroom and making the unexpected announcement.

A defendant often rests their case for one of two reasons. The most common is the argument that the prosecution failed to prove the elements of their case with their witness’s testimony, and that since the failure to prove their case is so obvious, no defense is necessary. Should that be the thinking on the part of the defense in this case, they are delusional in the extreme. 

The second reason can be that the defense simply has no witness to put on the stand who’s testimony would be helpful to their case and who would not be a liability on cross examination. (Put another way, they have no defense.) We pick reason number 2. The defense made all of the feeble arguments available to it during cross examination. ‘The nurses are mean. The nurses are vindictive. Tidwell thought he was following the law. Tidwell did not mean to break the law.’ Apparently Tidwell cannot even muster a few character witnesses to swear that he is a conscientious and honest attorney, lovely neighbor, or kind to animals. 

The jury will get the case on Monday and Law Med predicts a guilty verdict on all counts before the end of the day…before lunch if the jury instructions do not take too long.

    I worked with this guy and tried to explain that nurses are bound by the Nurse Practice Act to report safety issues with other medical professionals. He would not listen, said he would get those nurses, especially Ann Mitchell because he heard she called the doctor “a quack.”. Unfortunately for him, he was the one who was thrown under the bus by the very people he was so loyal to, especially the ex sheriff. This is a good example of karma and all I can say is it is coming back around for this group of “good ole boys.”

    It seems that all sorts of reliable sources tried to keep Tidwell from destroying his career in this case. From the Texas Medical Board, the defense attorney for the nurses, neighboring district attorney’s, other law enforement professionals and county attorneys, all said the same thing. Stop this nonsense…you are not operating within the law…you have no case.

    We would have loved to hear you testifying on the stand that Tidwell said he would ” get those nurses, especially Ann Mitchell because he heard she called the doctor “a quack.” That would be case closed.

    He threw himself under the bus. A bus which was moving at 5 miles an hour and which he had plenty of time to avoid.
